This Privacy Policy is published by OFFSIDER APP (ABN 35 621 314 403), of 40 Meridith Ave, Templestowe VIC 3106, Australia ("Offsider", "we", "us", "our"). We can be contacted at support@theoffsiderapp.com.au.

2. Scope

This policy applies to personal information we collect through the Offsider WhatsApp service (delivered via the WhatsApp Business Platform), our web dashboard at theoffsiderapp.com.au, and any related communications.

3. What personal information we collect

  • Phone number (from WhatsApp message metadata).
  • Display name (from your WhatsApp profile).
  • Profile avatar (from your WhatsApp profile).
  • The text content of messages you send to our WhatsApp number.
  • Media you send to our WhatsApp number, including photos, voice notes, and receipts.
  • Account information you provide directly via the web dashboard (name, email address, business details).

We do not collect location data, device contact lists, browsing history, biometric data, or payment card information.

4. How we collect personal information

We collect personal information when you message our WhatsApp number, when you sign up for or use the web dashboard, and when you contact us for support.

5. How we use your information

We use personal information to:

  • Provide task and job management features.
  • Provide AI-assisted scheduling, quoting, and message drafting.
  • Route communications between tradies, managers, and their customers.
  • Improve and secure the service.
  • Respond to support requests and legal obligations.

6. Disclosure to third parties

We disclose personal information to the following processors solely to operate the service:

  • Meta Platforms Ireland Ltd. — carries WhatsApp messages to and from you via the WhatsApp Business Platform.
  • Amazon Web Services (AWS) — hosts the application, database, and media storage in the Sydney region (ap-southeast-2).
  • MiniMax — performs large language model inference on message text to power AI features.

We do not sell personal information. We do not share personal information for third-party advertising.

7. Overseas disclosure

MiniMax processes message text outside of Australia. By using the service you consent to this overseas disclosure under Australian Privacy Principle 8. We take reasonable steps to ensure overseas recipients handle your information consistently with the Australian Privacy Principles.

8. Storage and security

We encrypt personal information in transit using TLS and at rest using AES-256 (Aurora MySQL and Amazon S3). We apply role-based access controls, do not keep production data on developer machines, and review our security practices on an ongoing basis. No system can be guaranteed completely secure.

9. Retention

We retain message and media data for up to 12 months after your account is cancelled, after which it is deleted. We may keep aggregated, de-identified analytics for longer to operate and improve the service.

10. Your rights

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles you have the right to:

  • Request access to the personal information we hold about you.
  • Request correction of inaccurate personal information.
  • Request deletion of your personal information.
  • Withdraw consent at any time (subject to legal exceptions).
  • Lodge a complaint with the Office of the Australian Information Commissioner at oaic.gov.au.

11. Children

The service is intended for adults using it in the course of a business. We do not knowingly collect personal information from anyone under 18. If you believe we have, contact us and we will delete it.

12. Changes to this policy

We may update this policy. We will notify active users of material changes via WhatsApp or email and update the "Last updated" date above.
